Loop hole in our constitution?

I have heard from many that our constitutional fathers had not foreseen the "intelligence" of Indians who can exploit the loop holes in it.

 Examples:

1) Dowry cases.

2) Female Infanticide 

But I think it that If we start to read book "India after Gandhi" by Ramachandra Guha (which gives the history after Indian Independence) we will see understand that this kind of rule breaking and exploitation of the loop holes are not only happening these days, it was happening even during and before Indian Independence. It’s what I call human nature.

I strongly believe in "If you don’t know your history, it is bound to repeat".

Especially in Indian society which is seriously confused about Indian Philosophy and talks about it as if they have digested every part of it and at the same time is exploiting this fact.

For ex: We say we Indians are very good hosts- this is a generalization. But do we invite a slum dweller and be good host for him or her? This is the generalization which I do not like.

WE say we are the society of high philosophical values but we certainly do not know what exactly Indian philosophy is all about. We cannot know it by short cuts, we have study it. Philosophy followed by our forefathers can be highly filtered out from its actual meaning because our forefathers would have had adapted to their requirements too. So if we say we are philosophical just because we follow what our fathers/mothers, grandfathers/granny s followed, then I think it seriously needs to be reconsidered.

Life principles are different from philosophy. Principles might be influenced by certain philosophy. But if you say you are very "principled" that does not mean you have digested entire philosophy!

Dr Ambedkar had foreseen that even then, because he had kindly said that "Political democracy cannot last unless there lies at the base of it social democracy. On the social plane, we have in India a society based on the principle of graded inequality, which means elevation for some and degradation for others. On the economic plane, we have a society in which there are some who have immense wealth as against many who live in abject poverty. On January 26, 1950, by adopting a democratic constitution, India upheld the principle of “one man one vote and one vote one value”. However, our society continued to be deeply iniquitous, “deny(ing) the principle of one man one value”.” How long shall we continue to live this life of contradictions?” “How long shall we continue to deny equality in our social and economic life? If we continue to deny it for long, we will do so only by putting our political democracy in peril. We must remove this contradiction at the earliest possible moment or else those who suffer from inequality will blow up the structure of political democracy which this Assembly has so laboriously built up.”

But I am very optimistic about our constitution and Legal system and if it is rightly understood you can use it to its most and even very notorious lawyers can be affronted. We do not have time to read all these (or that’s what we say!) and just blame our constitution and our constitutional fathers.
